Brazilian Court Revokes Apple’s Mandate to Enable Sideload and Allow Payment Outside of App Store within 20 Days: Deemed as Excessive Decree

Previously, Brazilian regulators had ordered Apple to open up the App Store for developers to add payment methods without using the In-App system. They also required developers to be able to distribute app downloads through other channels within a 20-day deadline, or face a daily fine of up to 250,000 reals (approximately 1.5 million baht).

Apple has filed a petition to the court, stating that it is impossible to implement the system changes as per the regulators’ orders within the 20-day timeframe due to various technical complexities (even though it has been done in the EU). They also mentioned that the orders would increase security and privacy risks for users, which need to be balanced.

Recently, the Brazilian Central Government Court ruled to revoke the regulators’ orders, citing that the 20-day deadline was too rushed and unnecessary for such a short timeframe.

However, this court ruling does not mean that Apple is exempt from adding access to the App Store in Brazil, but rather the enforcement timeline may be extended. It is expected that the regulators and Apple will file appeals to seek a new resolution.
