Emoticon Luna Smiles ๐ŸŒ Transforms into the Epicenter of a Stock Manipulation Lawsuit

There is an interesting lawsuit in the United States regarding the meaning of emoji symbols ๐ŸŒ and whether they signify stock market manipulation. The case arose in 2022 when renowned investor Ryan Cohen, who is currently the chairman and CEO of GameStop (resulting from his significant ownership of GameStop shares), invested in the furniture retailer Bed Bath & Beyond.

In August 2022, Cohen, who is known as the “meme king” due to his regular communication with the public on Twitter, responded to a tweet from CNBC about the declining stock price of Bed Bath & Beyond. He expressed his opinion by saying, “At least her cart is full,” accompanied by a full moon face emoji ๐ŸŒ (officially known as the Full Moon Face emoji).

Since Cohen already held a 9.8% stake in Bed Bath & Beyond, his tweet caused a stir when the company later repurchased shares from minor investors, resulting in a decrease in the overall share value. As a result, Cohen’s ownership percentage increased to 11.8%, without any change in the actual number of shares he held.

This increase in Cohen’s ownership percentage led some investors to mistakenly believe that Cohen was serious about accumulating Bed Bath & Beyond shares as implied by his ๐ŸŒ emoji post. They interpreted it as a “to the moon” symbol, indicating that the stock price would skyrocket. Consequently, this group of investors rushed to buy Bed Bath & Beyond shares, causing an immediate increase in the stock price.

However, the very next day, Cohen sold his entire stock, making a profit of nearly $70 million. As expected, the stock price plummeted, leaving these investors dissatisfied, and they subsequently filed a lawsuit against Cohen, accusing him of stock manipulation through his ๐ŸŒ emoji post, which misled them and caused financial losses.

Currently, the case is still in court, with the ๐ŸŒ emoji becoming the centerpiece of this dispute. The defense argues that it is impossible to definitively determine the meaning of a small cartoon image. However, the court’s perspective is that emojis may indeed carry meaning.

The importance of emoji communication in the business world, particularly in the technology sector, continues to grow. Prior examples include FTX, where internal payments within the company are approved through chat using specific emojis, confirming genuine approval. Another instance involves Open AI, where employees protested symbolically by using emojis in the company’s Slack chat room when CEO Sam Altman was ousted.

TLDR: A lawsuit in the United States revolves around the meaning of the ๐ŸŒ emoji and its potential role in stock manipulation. Ryan Cohen’s tweet about Bed Bath & Beyond’s stock drew attention, causing investors to mistakenly interpret the emoji as a signal to buy, resulting in financial losses. The case highlights the increasing significance of emoji communication in the business world, as emojis become subject to interpretation and potential legal consequences.
