European Union Slams Apple for Potential Violation of DMA Laws by Imposing Additional Terms on Developers in European App Store

According to previous reports, the European Commission, also known as EC, has preliminarily notified that Apple may be in violation of the Digital Markets Act (DMA) due to imposing conditions that restrict developers from providing users with alternative download methods outside of the App Store, as stipulated in the DMA.

The EC has noted that Apple has adjusted developer terms in the European region in a way that makes it difficult to download apps through channels other than the App Store. This includes (1) Apple prohibiting apps from informing users that alternative payment methods are cheaper, (2) Apple only allowing insertions of links bound to its system, limiting developer communication freedom, and (3) Apple controlling revenue share for downloads through other channels, which the EC views as excessive control.

In the next steps, the EC will conduct further investigations, and if found to be in violation of the DMA, Apple may face fines up to 10% of its global revenue.

Additionally, the EC has announced preparations to further scrutinize Apple’s changes in various aspects, including Core Technology Fee charges, complex processes for downloading apps through alternative stores, and conditions for developers to provide additional download channels.
