Financial App Victorious in Lawsuit After Bank Presses for Payment; Court Rules Against Self-Withdrawal

The Consumer Council reports a case involving a consumer who was sued by a bank. This consumer fell victim to a money sucking app, which led to money being sucked out without their consent. The perpetrator even increased credit card limits and withdrew cash.

The bank, issuer of the credit card, filed a lawsuit because the consumer did not pay for the transactions made by the criminal. After legal proceedings, the Consumer Council appointed assisting lawyers. The Rayong Provincial Court issued a judgment on August 28, stating that the consumer did not conduct the transactions themselves, and the transferred money was not theirs.

Currently, assistance for victims of money sucking apps is being evaluated on a case-by-case basis. The Bank of Thailand had mentioned in the beginning of last month that they are in the process of improving law enforcement, but it is limited to cases where the bank cannot close the loophole within one month. The bank will then take full responsibility.
