United States Judiciary Temporarily Suspends Apple Watch Ban in America – a Transient yet Ephemeral Intermission

Following the issuance of a ban by the ITC on the importation of Apple Watch Series 9 and Apple Watch Ultra 2 for sale in the United States, due to alleged patent infringement on Masimo’s blood oxygen measuring system, Apple has decided to halt the sales of these two models before the ban takes effect on December 26th.

However, Apple has recently filed a motion to temporarily suspend this order, which has proven successful. The latest development reveals that the appellate court has issued a temporary stay on the ban, requiring the ITC to provide supporting information for the imposition of the ban by January 10th, 2024. This means that Apple will be able to continue selling these two problematic Apple Watch models in the United States for almost two weeks.

As of now, Apple has not announced whether they will resume sales of the affected Apple Watch models or not.

TLDR: The ITC ban on the importation of Apple Watch Series 9 and Apple Watch Ultra 2 has been temporarily suspended by the appellate court. Apple has the opportunity to continue selling these banned models in the United States for almost two weeks, pending the ITC’s submission of supporting information. The company’s decision regarding the future sales of these watches is currently unknown.
