US Court Orders Apple to Cease Sales of Two Apple Watch Models Repeatedly Infringing Patent Rights

The United States Supreme Court has issued an order denying Apple’s request to suspend the ban on the sale of Apple Watch Series 9 and Apple Watch Ultra 2. This ban was imposed by the ITC due to a patent infringement on Masimo’s blood oxygen measuring system. Previously, the court granted Apple temporary permission to continue selling the products, pending further information.

As a result of this order, Apple is once again required to halt the sale of both models of Apple Watch with the mentioned issues in the United States. This will take effect from 5:00 PM on January 18th, based on local time.

However, the US Customs authorities have recently made a decision stating that Apple has designed an Apple Watch that operates outside the scope of the banned devices. It is speculated that Apple may have utilized software to disable the blood oxygen measuring system. Therefore, it remains to be seen whether Apple will discontinue sales or reintroduce the product with immediate functionality.

TLDR: The US Supreme Court rejected Apple’s request to suspend the ban on Apple Watch Series 9 and Apple Watch Ultra 2 due to alleged patent infringement. Consequently, Apple must cease sales of these models in the US, while the US Customs authorities have identified a potential workaround that could allow Apple to continue selling a modified version of the watch in question.
